1.1 Important Notice

All products sold by Biopunk Peptides (“Biopunk,” “we,” “us,” or “our”) are strictly intended for laboratory research use only (RUO). They are not intended for human or animal consumption, and not intended for clinical, therapeutic, diagnostic, or veterinary applications.

1.2 Definitions

“Buyer” means any individual, entity, or organization that purchases, orders, or receives products from Biopunk Peptides.
“Products” means any chemical, compound, or substance offered for sale by Biopunk, including research peptides and related materials.
“Research Use Only (RUO)” means that products are intended exclusively for laboratory research and analytical purposes, and not for human or veterinary use, clinical applications, or diagnostic purposes.
“Misuse” means any use of products inconsistent with these Terms, including but not limited to human or animal consumption, clinical or diagnostic application, or unauthorized resale.

1.3 Qualified Purchaser Agreement

By purchasing from this website, you certify that you:

Are at least 21 years of age.
Are a qualified researcher, scientist, institutional purchaser, or otherwise capable of safely handling these substances in an appropriate laboratory environment.
Understand that purchases are not for personal, recreational, or self-use purposes.
Possess the knowledge, training, and equipment necessary for safe handling, storage, and disposal.
Will comply with all applicable local, state, federal, and international laws, including the Federal Food, Drug, and Cosmetic Act (FD&C Act).
Are located in the United States. Retail orders ship to United States addresses only (all 50 states); see §1.10 regarding wholesale and international inquiries.
Assume all risks and liabilities arising from handling or use of the products.

1.4 Prohibited Uses

The following uses of any Biopunk Peptides product are strictly prohibited:

Human or veterinary consumption of any kind
Injection, ingestion, inhalation, or topical application
Use in clinical, therapeutic, or diagnostic contexts
Compounding, repackaging, or resale as drugs, dietary supplements, or cosmetics
Incorporation into foods, drugs, medical devices, or cosmetics
Commercial use outside of legitimate laboratory research
Any use that violates applicable local, state, federal, or international laws

These products have not been evaluated for safety, efficacy, or any medical use. Misuse may constitute a violation of federal, state, or international law.

1.5 Buyer Responsibilities

The Buyer assumes all risks and liabilities associated with handling, use, storage, and disposal of products. The Buyer is responsible for:

Implementing safety and hygiene protocols
Warning others of potential hazards
Preventing unauthorized access or misuse
Ensuring lawful and appropriate use
Proper storage and handling procedures
Compliance with applicable chemical safety guidelines

The Buyer indemnifies and holds harmless Biopunk Peptides and Biopunk Labs LLC from any claims, liabilities, or damages arising from misuse.

1.6 Regulatory Compliance

Biopunk Peptides operates in accordance with applicable research chemical regulations and industry standards.

Research Use Only products:

Are not approved by the FDA for medical use
Are not intended for therapeutic, diagnostic, or clinical applications
Must not be marketed or represented as treatments for disease
Must only be handled in appropriate research environments

Under U.S. regulations, any substance intended for diagnosis, treatment, or prevention of disease must undergo FDA approval before being marketed for those purposes.

1.6.1 Toxic Substances Control Act (TSCA)

Biopunk products are intended solely for research purposes. The purchaser acknowledges that some products may not appear on the TSCA inventory listing. The purchaser assumes full responsibility for ensuring that products purchased are approved for use under TSCA, where applicable.

1.7 Product Classification & Labeling

All Biopunk products are labeled in accordance with 21 CFR 809.10(c) as Research Use Only (RUO).

Biopunk products are:

Not controlled substances under federal law
Not listed on the FDA drug registry
Not classified as dietary supplements

1.8 Sales Policy & Purchase Restrictions

Biopunk Peptides reserves the right to:

Restrict, limit, or refuse sales to any customer
Cancel orders without prior notice
Deny service to any individual or entity
Suspend or terminate accounts for suspected non-compliance
Refuse to ship to any address

All sales are subject to these terms. Biopunk bears no liability for denied or cancelled orders.

Order changes and cancellation. Buyers may request changes or cancellation within twelve (12) hours after payment. After the 12-hour window, orders enter fulfillment and cannot be modified or cancelled.

1.9 Payment & Disputes

Biopunk Peptides accepts credit and debit card payments and direct cryptocurrency payments. All payments are handled by third-party payment providers; Biopunk does not process card data or custody cryptocurrency wallet credentials.

Card payments are routed through Verified Crypto Checkout (“VCC”, verifiedcryptocheckout.com), which forwards the transaction to a third-party hosted checkout provider (such as Stripe, MoonPay, or Binance) for card processing. The hosted provider processes the card, converts the payment to USDC (a US-dollar-pegged cryptocurrency), and settles USDC to Biopunk’s Polygon-network wallet.

Direct cryptocurrency payments (customer-originated wallet transfers) are processed by Nowpayments.

Additional payment terms:

All payments are denominated in USD at the prevailing exchange rate at time of checkout.
Blockchain transactions are irreversible. It is the Buyer’s responsibility to ensure wallet addresses and transaction details are correct before sending.
Refund mechanics. If Biopunk is unable to fulfill an order and must issue a refund: (a) for card payments, the refund is initiated back through the hosted checkout provider that processed the original card transaction, subject to that provider’s refund policies and timing; (b) for direct cryptocurrency payments, the refund is issued to the originating wallet in the same cryptocurrency received, subject to blockchain network fees. Where a card refund cannot be completed through the original provider (for example, if the hosted provider has closed the merchant relationship or the original transaction is beyond that provider’s refund window), Biopunk may, at its discretion, offer an alternative refund in USDC to a wallet address provided by the Buyer.
Cryptocurrency price volatility after the transaction is executed is the Buyer’s responsibility.

Dispute Resolution

We strongly encourage customers to contact us directly before initiating any payment dispute. Most issues can be resolved quickly through our support team.

If a Buyer initiates a chargeback, reversal, or similar dispute mechanism through a payment processor:

We may restrict or suspend future orders associated with that account.
We reserve the right to refuse future service.
Buyers found to be abusing dispute mechanisms may be reported to relevant authorities.

1.10 International Orders

Biopunk Peptides currently ships retail orders to United States addresses only (all 50 states). Retail orders placed with a non-US shipping address will be canceled and refunded.

Wholesale and international inquiries. Biopunk may fulfill qualified wholesale or bulk research-supply orders to international destinations on a case-by-case basis, subject to a separate written wholesale agreement, satisfactory KYC and end-use verification, and compliance with all applicable US export controls and destination-country import laws. International wholesale prospects should contact [email protected] to inquire about eligibility. Biopunk reserves the right to accept or decline any wholesale request at its sole discretion.

1.11 Limitation of Liability

Biopunk Peptides, Biopunk Labs LLC, and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

Use, handling, or misuse of products
Failure to comply with these Terms or applicable laws
Blockchain transaction errors or cryptocurrency volatility

1.12 Monitoring & Enforcement

Biopunk Peptides reserves the right, at its discretion, to:

Cancel or refuse orders if misuse or non-compliance is suspected
Cooperate with regulatory or law enforcement authorities
Review order patterns for compliance purposes

1.13 Intellectual Property

All website content, including text, graphics, logos, images, and code, is owned or licensed by Biopunk Labs LLC. Unauthorized copying, reproduction, distribution, or commercial use is prohibited without written consent.

1.14 Privacy & Data Collection

By using our website or purchasing products, you consent to our collection and use of personal data in accordance with our Privacy Policy. We do not sell or share personal information with third parties except as required by law or as necessary to fulfill orders.

1.15 Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles.

1.16 Dispute Resolution; Arbitration; Class Action Waiver

1.16.1 Informal resolution. Before initiating any formal proceeding, the parties agree to attempt to resolve any dispute arising out of or relating to these Terms or the products through good-faith negotiation for at least thirty (30) days after written notice of the dispute is provided to the other party.

1.16.2 Binding arbitration. If the parties cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or Buyer’s purchase or use of the products (including their formation, breach, termination, validity, interpretation, or enforcement) shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator, seated in Wyoming, and conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.

1.16.3 Class action waiver. Buyer and Biopunk each agree that any dispute shall be brought only in an individual capacity, and NOT as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of §1.16.2 (Binding Arbitration) shall be null and void as to that dispute, and the dispute shall proceed in the courts specified in §1.16.5.

1.16.4 Exceptions. Notwithstanding §1.16.2, either party may bring an individual action in small claims court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, or to enforce this arbitration provision.

1.16.5 Forum for non-arbitrable matters. For any claim not subject to arbitration under §1.16.4 or if arbitration is found unenforceable, the parties consent to the exclusive jurisdiction of the state and federal courts located in Wyoming.

1.17 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

1.18 Force Majeure

Biopunk Peptides shall not be held responsible for delays or failures in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, government action or regulation, labor disputes, power or telecommunications failures, internet or blockchain network outages, cryptocurrency exchange disruptions, cyber attacks, or supplier failures. Obligations delayed by a force majeure event will resume once the event ends, and no interest or penalty will accrue during the delay period.

1.19 Assignment

Buyer may not assign, transfer, delegate, or subcontract any of Buyer’s rights or obligations under these Terms without Biopunk’s prior written consent. Any attempted assignment in violation of this section is void. Biopunk may assign or transfer these Terms, in whole or in part, without Buyer’s consent, including in connection with a merger, acquisition, sale of assets, corporate reorganization, or by operation of law.

1.20 Amendments

These Terms may be updated at any time. Continued use of the website constitutes acceptance of the current version. The effective date at the top of this page indicates the most recent revision.
